IMPORTANT NOTICES:

PLEASE READ THIS AGREEMENT CAREFULLY. IT CONTAINS AN ARBITRATION CLAUSE REQUIRING BINDING ARBITRATION TO RESOLVE DISPUTES. SEE THE "ARBITRATION AND WAIVER OF CLASS REMEDY AND JURY TRIAL" SECTION BELOW.

BY ACCESSING OR USING MYFLASHPAY SERVICES IN ANY WAY, YOU AGREE TO BE BOUND BY THESE TERMS.

TO USE OUR SERVICES, YOU MUST CONSENT TO ELECTRONIC COMMUNICATIONS. IF YOU REVOKE THIS CONSENT, YOU MAY NOT CONTINUE USING THE SERVICES.

A. ELECTRONIC COMMUNICATIONS

MyFlashPay will send all notices, agreements, disclosures, receipts, and other communications ("Communications") electronically. You must:

Maintain a valid email address

Promptly update your contact info

Have a device with internet access and PDF viewing capabilities

You may print communications or request paper copies (fees may apply). Withdrawal of consent ends your access to services.

B. THE MYFLASHPAY ONLINE SERVICES

1. Description

MyFlashPay allows individuals to send money domestically and internationally to recipients via:

  • Bank deposit

  • Mobile wallet

  • Cash pickup (where available)

2. Eligibility

You must:

  • Be at least 18 years old and a U.S. resident

  • Register and create a User Account

  • You agree not to use the services for:

  • Gambling, escrow, illegal purchases

  • Sending to unknown parties or sanctioned countries (e.g. North Korea, Iran, etc.)

3. Account Setup and Security

You are responsible for maintaining the confidentiality of your login credentials

Notify MyFlashPay immediately if your account is compromised

4. Sending Money

Transfers may be funded via ACH, debit, or credit card (as permitted)

Fees, exchange rates, and limits will be disclosed prior to confirmation

All transfers are subject to identity verification and compliance checks

5. Receiving Funds

Funds will be delivered based on the receiver's payout method (e.g., bank, wallet, cash)

Collection may require the recipient to provide ID, reference number, or test question

6. Refunds and Transfers

Expired, failed, or cancelled transfers may be refunded to the original payment method

Fees may apply for uncollected or reversed transfers

D. INDEMNIFICATION

You agree to indemnify MyFlashPay and its affiliates from all liabilities arising from your use of the service in breach of this agreement.

E. LIMITATION OF LIABILITY

MyFlashPay is not liable for:

  • Delays or losses due to events beyond our control

  • Issues caused by your error, insufficient funds, or third-party actions

  • Maximum liability is limited to a refund of the amount sent and associated fees.

F. ARBITRATION AND WAIVER OF CLASS ACTION

Disputes will be resolved via binding arbitration administered by the American Arbitration Association (AAA). No class actions permitted. Arbitration may occur via phone, online, or in person in your jurisdiction.

G. CHANGES TO THIS AGREEMENT

Terms may change. Notice of changes will be provided via email or website updates.

H. PRIVACY

MyFlashPay collects, uses, and shares personal information in accordance with our Privacy Notice. We may share data with affiliates and partners to provide services and comply with legal requirements.

I. STATE-SPECIFIC RIGHTS

Some states may provide additional consumer rights. Refer to our website or contact support for more information.

J. WEBSITE TERMS OF USE

Use of MyFlashPay’s website and app is subject to our Terms of Use.

K. MISCELLANEOUS

This agreement is governed by the laws of the State of Delaware.

If any part is invalid, the rest remains enforceable.

This is the full agreement between you and MyFlashPay.
